An attitude on the principle of prohibition of opposing behavior and speech in international documents and Iranian law

Abstract

According to what is called the principle of prohibition of conflicting behavior and speech, in contracts, the party to the contract who acted reasonably based on trusting the speech and behavior of the other party to the contract, such a person in good faith is protected by international laws and documents. And the other party to the contract no longer has the right to speak and behave contrary to his previous behavior and speech. Therefore, the other party is deprived of the right to refer to the text of the contract with the condition contained in the contract. This principle is recognized in international documents and laws of different countries. What has been examined in this research is the mention of materials related to this principle in international documents and also how this principle is accepted in Iranian law. The result of this research shows that this principle in the articles related to the irrevocable demand and the exception of the exclusive articles is based on the principle of prohibition of behavior and speech contrary to the international documents and Iranian law and 145 amendments in written form, the theory of the representative's apparent authority, as Commonly identified in international documents and other specific materials.
