Abstract
Possession of property is a common element of all crimes against property. The criminal and legal laws of Iran have in some cases raised the issue of belonging to others, including the articles of the Islamic Penal Code regarding theft, fraud, and betrayal of trust, and in the civil law, the concept of this belonging to others in some way in articles such as Articles 35 and 582 And 583 has come. Due to the fact that the definition of belonging to property is not easy and can include ownership and all kinds of possessions, in this article, by referring to the laws of the Islamic Republic of Iran and the opinions of the Supreme Court, it has been tried to clarify the concept of this issue. |
